It is an unfortunate fact of life that sometimes courts issue unfair decisions.
If you feel the judge’s decision was incorrect, we can appeal that decision, provided that certain procedural steps are followed. However, appellate court’s rarely reverse a trial judge’s decision because trial judges have broad discretion in dissolution of marriage cases.
An appeal is more appropriate when the trial judge makes an error of law or there is an abuse of discretion. In such cases the appellate court is more likely to reverse the trial judge’s decision.
The success of your appeal will be limited when your only reason for appeal is displeasure with the judge’s decision.
Time is of the essence in the appeals process. You must decide quickly whether to appeal the final judgment because an appeal must be filed within 30 days from the date that the order you are appealing is filed in court.
